New YorkThe New York State Department of Environmental Conservation promulgated new regulations in 2017 that set requirements for asphalt shingle recycling and recovery. Parts 360 and 361 pertain specifically to these types of facilities. Use of recycled asphalt shingles is pursuant to beneficial use requirements set in section 360.12. Section 361-5.4 (c) restricts accepting friable asbestos-containing waste and handling non-friable asbestos containing waste that would cause it to become friable (i.e. grinding). Definitions of asbestos containing materials are provided in part 360. Per state specification set in 2015, the New York State Department of Transportation allows 2% ground shingles to be allowed in mixtures. RAS is required to be certified that it is asbestos free to be used in asphalt mixtures. Department of Environmental Conservation Professional Engineer (Environmental)
